Cedar+Slate Privacy Policy

1. About this policy

Cedar+Slate™ respects your privacy and aims to handle personal information openly and responsibly.

This Privacy Policy explains how P1 Shootout Pty Ltd (ABN 87 683 900 183), trading under the registered business name Cedar & Slate and the customer-facing brand Cedar+Slate™ (collectively, Cedar+Slate, we, us or our), collects, holds, uses and discloses personal information.

It applies across our websites, mobile and web applications, software, subscriptions, support channels and other products or services that link to this policy (collectively, the Services). It is intended to cover Services that Cedar+Slate offers now or introduces in the future. A Service may also provide a short collection notice when particular information is requested.

We seek to comply with applicable privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us.

2. Information we may collect

The information we collect depends on the Service and features you use. It may include:

  • Account and identity information, such as your name, email address, telephone number, business name, login details and account identifiers.
  • Subscription and transaction information, such as your plan, subscription status, transaction history and limited billing information. Payments may be processed by an app store or payment provider, and we do not necessarily receive or store your full payment-card details.
  • Customer content, such as photographs, receipts, documents, files, notes and other material you upload, capture, create or store using a Service.
  • Content metadata, such as capture date and time, file information, upload status and information associated with customer content.
  • Location information, such as GPS coordinates and location accuracy, when a Service offers a location feature and you grant the required device permission.
  • Device, technical and usage information, such as device type, operating system, browser, IP address, app version, identifiers, diagnostic information, crash records, security logs, pages or features used, and dates and times of access.
  • Communications, including support requests, feedback, survey responses and other correspondence with us.
  • Website information, such as information collected through cookies or similar technologies used for essential functionality, preferences, security and, where disclosed, analytics.

Customer content may incidentally contain personal or sensitive information about you or another person. You should only upload information you are authorised to provide and that is reasonably necessary for your use of the Service.

3. How we collect information

We may collect information:

  • directly from you when you register, subscribe, upload content, use a feature, contact us or otherwise interact with a Service;
  • automatically from your browser, device or use of a Service;
  • from Apple, Google, payment providers, authentication providers and other services you choose to connect;
  • from an organisation that creates or administers an account for you; and
  • from public sources or service providers where lawful and reasonably necessary for our business.

If you do not provide information that is required for a feature, we may not be able to provide that feature. Optional information and permissions will be identified where reasonably practicable.

4. Camera, files and location permissions

Some Services may request access to your device's camera, photo library, files or location. We use these permissions only to provide the relevant feature, such as capturing and storing an image, selecting a file, or recording where content was captured.

You can manage device permissions through your device settings. If location access is optional for a Service, declining it will not prevent you from using the Service's core non-location features. Location is not continuously tracked unless a Service clearly explains that functionality and obtains the required permission.

5. Why we use information

We may use personal information to:

  • provide, operate, maintain and secure the Services;
  • create and administer accounts and subscriptions;
  • store, synchronise, display, search, export and delete customer content as directed by users;
  • process transactions and confirm subscription status;
  • provide customer support and respond to enquiries, complaints and requests;
  • send important service, security, billing and policy communications;
  • diagnose faults, prevent abuse and improve reliability and usability;
  • understand how the Services are used and develop new or improved features;
  • protect our users, Cedar+Slate and others from fraud, security threats or unlawful activity;
  • comply with legal obligations and enforce our agreements; and
  • send marketing communications where permitted, with an option to unsubscribe.

We do not sell personal information. We do not use customer content for advertising. If our practices materially change, we will update this policy and provide any notice or choice required by law.

6. When we disclose information

We may disclose information to:

  • cloud hosting, storage, database, authentication, email, analytics, diagnostics, customer-support and security providers that help us operate the Services;
  • Apple, Google, payment processors and subscription-management providers involved in purchases or account management;
  • professional advisers, insurers, auditors and contractors who need the information to provide services to us;
  • a purchaser, investor or successor in connection with a proposed or completed restructure, financing, sale or transfer of all or part of our business, subject to appropriate confidentiality and legal requirements;
  • law-enforcement agencies, regulators, courts or other parties where required or authorised by law; and
  • other parties where you direct us or give consent.

We require service providers to handle information only for the authorised purpose and subject to appropriate protections where reasonably practicable.

7. Overseas processing

Some service providers may store or process information outside Australia. Our current website and communications infrastructure includes providers that may process information in Australia and the United States. Future Services may use providers in other countries.

We assess the providers used by each Service and, where practicable, will identify additional likely processing countries in this policy or in an appropriate collection notice before the relevant processing begins.

8. Security and reliability

We use reasonable technical and organisational measures designed to protect information against loss, misuse, interference and unauthorised access, modification or disclosure. Measures may include encryption in transit, access controls, authentication, monitoring, backups and restricted administrative access.

No internet transmission or storage system is completely secure. You are responsible for keeping your login details confidential, maintaining control of your devices and notifying us promptly if you suspect unauthorised access.

9. Retention, deletion and backups

We retain information for as long as reasonably necessary to provide the Services, maintain security and business records, resolve disputes, enforce agreements and comply with legal obligations.

When an account or content is deleted, information may remain temporarily in backups, logs or recovery systems before being securely deleted or de-identified in accordance with our normal retention processes. We may retain limited information where required by law or reasonably necessary for fraud prevention, security, dispute resolution or financial record-keeping.

Where a Service allows account creation, users will be given a way to request account and associated-data deletion from within the Service and through a publicly accessible Cedar+Slate channel, subject to lawful retention requirements.

10. Access, correction, export and privacy choices

You may ask us to:

  • provide access to personal information we hold about you;
  • correct information that is inaccurate, out of date, incomplete, irrelevant or misleading;
  • explain our handling of your information;
  • delete your account or information where applicable; or
  • provide information about available export options.

Contact support@cedarslate.com.au. We may need to verify your identity before completing a request. In some circumstances, the law permits or requires us to refuse or limit a request; if so, we will explain our decision where required.

You may also manage marketing preferences using the unsubscribe option in a message and manage app permissions through your device settings.

11. Analytics and automated decisions

We may use aggregated, de-identified or limited usage information to measure performance, diagnose faults and improve the Services.

We do not currently arrange for computer programs to use personal information to make decisions that could reasonably be expected to significantly affect a person's rights or interests. If that changes, we will update this policy and provide information required by applicable law before the relevant practice begins.

12. Children

The Services are not directed to children under 16 unless a Service clearly states otherwise. We do not knowingly seek to collect personal information from children without appropriate consent or another lawful basis. If you believe a child has provided personal information contrary to this section, contact us.

13. Third-party services and links

The Services may contain links to or integrate with third-party services. Their privacy practices are governed by their own policies. We encourage you to review those policies before providing information to them.

Please describe your concern and provide enough information for us to investigate it. We will acknowledge and investigate privacy complaints and aim to respond within a reasonable period.

If you are not satisfied with our response, you may be entitled to contact the Office of the Australian Information Commissioner at oaic.gov.au.

15. Changes to this policy

We may update this policy as our Services, providers or legal obligations change. The current version will be published at this URL with its effective date and version number. If a change materially affects how we handle existing personal information, we will take reasonable steps to provide additional notice where required.
